GENERAL TERMS AND CONDITIONS OF CONTRACT

1. General conditions 1.1. These general terms and conditions of contract together, where appropriate, with the specific conditions that may be established, will expressly regulate the relations arising between Nucs, a registered trademark by Jorge Martínez Pallarés with ID (DNI) 53225257Z (hereinafter Nucs) and third parties (hereinafter “Users”) who contract the services offered through it. 1.2. These General Conditions have been prepared in accordance with the provisions of Law 34/2002, on information society services and electronic commerce, Law 7/1998 on General Contracting Conditions and DECREE 4/2024, of January 4, of the Consell, regulating active tourism in the Valencian Community.

2. Terms of service 2.1. The contracted activities are carried out in the natural environment where there are risks inherent to its own nature which can produce fortuitous accidents that are beyond human control. The client, when contracting our activities, knows and assumes said risk, accepting to participate in the activity. 2.2. The participants express their acceptance to comply with the guides’ instructions to guarantee the safety and fluidity of the activity. Ignoring these instructions exempts the guides and the company from all responsibility. 2.3. The participants agree to inform the guide if they suffer from any type of illness or disability that could alter the normal functioning of the activity. 2.4. Participants assume the risk for their own objects that they decide to use during the activity. The company has water protection equipment for the exclusive use of the instructors; if a participant uses any of this equipment to store their objects, said participant will assume the risk that the protection equipment may fail, damaging their properties, and the entity is not held responsible. 2.5. The guides will have the power to deny participation to those participants who do not wear the appropriate equipment for the activity, lack the appropriate physical condition or whose behavior implies endangering the rest of the group. 2.6. Underage participants must always be accompanied by a Father, Mother or Guardian. 2.7. The participant is responsible for the equipment given to them to carry out the activity and must return it complete at the end of it. In case of loss of any of the elements during the course of the activity, they must pay its value.

3. Booking conditions 3.1. Generally, reservations will be made through the web portal www.nucs.pro although it is possible, in particular cases, to make them through other means of communication or with intermediaries. 3.2. Generally, a 25% deposit must be paid to make the reservation except for activities with promotions in which a larger amount may be requested provided it results in savings for the client. 3.3. The cancellation of the reservation will only imply the refund of the deposit if it is made 15 days in advance. Up to a week before, the cancellation will imply the return of 50% of the deposit; subsequently, no refund will be made. 3.4. Failure to show up for the activity on the indicated day and time, or arriving with a delay of more than 30 minutes, will result in the loss of the deposit and the cancellation of the activity for the participants. 3.5. In the event that on the same day the activity begins, the weather conditions pose a danger to the integrity of the participants, an alternative activity will be proposed that, due to its characteristics, is not affected by the weather. If this is not possible or it is not to the liking of the majority of the participants, it would be postponed or a voucher for the deposited value would be generated to exchange for other services.

4. Data protection 4.1. In compliance with Organic Law 3/2018, of December 5, on the Protection of Personal Data, we inform you that any personal data you provide us will be included in an automated personal data file, created and maintained under the responsibility of Nucs. The purpose of said file is to facilitate the processing of reservations and, in the event that you have expressly authorized us in the corresponding box, also to send you commercial communications about products and services that may be of interest to you. 4.2. Nucs clients may at any time exercise their rights of access, modification, cancellation and opposition, communicating it by email to info@nucs.pro 4.3. Participants accept the publication of photographs taken during the different activities on the Nucs website or in the advertising media it deems appropriate. Only in cases where there is an express and written statement by the participant not to publish their image in any medium, will Nucs not make use of the photos taken during the different activities.
